In simpler terms, if the Delta-9 content in any given hemp product makes up less than 0.3% of the total weight of the product, it’s good to go!
The bill also mentions that “hemp products” mean all goodies derived from, or made by, processing hemp plants or hemp plant parts, that are available for commercial sale. Translation? It means that hemp products on the market such as smokables, cosmetics, or even edibles that the law defines as “food intended for animal or human consumption” are totally legit. And that’s not all, even cloth, fiber, fuel, paint, paper, and anything in between made it to the list of the legal territory. However, unprocessed or raw plant material, including non-sterilized hemp seeds, didn’t make the cut as a “hemp product.
In addition, the bill discusses “handling,” which means possessing aka “having” or keeping hemp around. Handling includes having or storing hemp, even in a vehicle, except when you’re moving it directly from one licensed place that grows or processes hemp to another licensed place. It’s important to note that handling doesn’t cover possessing or storing finished hemp products. You’ll need the proper docs and licenses to do any “handling.”
So, in short, as long as your Delta-9 product keeps it under the 0.3% D9 THC mark, South Carolina says you’re good to go! However, if you’re in the business, you’ll need some more paperwork to go through depending on which part of the bizz you’re in, be it growing, processing, handling, or selling.
