Few state laws specifically address the issue at this time—most state laws cover more general language about marijuana, cannabis, THC, CBD, or D9THC. There are only 11 states where delta 8 is illegal according to their state law.

The federal Drug Enforcement Administration (DEA) has, Delta-8 THC was proposed to be placed in Schedule I under a new rule, which would make it federally illegal. That rule is not yet final. 

Delta-8 THC is a derivative of cannabis that can be found in very small concentrations. Delta-8 THC is also known as marijuana’s degradation product and is primarily sourced from hemp, not cannabis. To be more specific, nearly all delta-8 THC currently on the market is derived from CBD isolate extracted from federally legal hemp, which means the majority of Delta-8 THC that is on the market today is derived from hemp.

Additionally, the DEA released an Interim Final Rule in August 2020, a document meant to update and confirm the differences between hemp and cannabis products in general.

That interim rule said: “All synthetically derived tetrahydrocannabinol remain Schedule I controlled substances,” which would make delta-8 illegal because it is THC that is extracted or synthetically derived. 

The Legal status is whether the farm bill’s language stands, which outlaws plants with more than 0.3% delta-9 THC, or the new IFR language is adopted, which bans all THC-related compounds and determines if delta-8 is federally banned. The DEA’s IFR is open for review until October 2021, and until then, delta-8 legality remains hazy on a federal level.
