The rule defines the term “synthetically derived THC,” which gives the DEA room to treat Delta 8, chemically derived from hemp CBD as “synthetic substances” that is derived” THC and a controlled substance.
The Federal Analogue Act (FAA) banned synthetically derived THC, like K2 and spice. The reasoning was to stop the spread of harmful chemicals. These fake THC’s is made in a lab without any cannabis plant material involvement.
Specialists argue that making Delta 8 is different because it is created with hemp-derived CBD.
The regulation on Delta 8 products for human consumption falls under the FDA, per the 2018 Farm Bill. Under the bill, even if Delta 8 products intended for human consumption are considered legal per federal law, they need pre-market approval from the FDA, just like CBD and other cannabinoids.
Delta 9 is in the cannabis plant, consisting of two variations: The marijuana plant consists of high THC levels and low levels of CBD. Delta 8 THC is at about half its adequate strength and produces considerably more mellow, less psychoactive results, however many reports that it has the same effects towards various conditions as Delta 9 has. The Cannabis Sativa L, also known as the hemp plant, has much less THC and high levels of CBD.
However, people who have used both tend to agree that Delta 8 is less anxious-provoking and a more effortless experience than Delta 9, which is also one of the main reasons this newer THC compound has grown so popular over the last few years.
